Terms of use

These Terms of Use (TOU) govern the access to and use of our technology platform, application software, mobile apps, including App called “Mera Neta”, website, and service (collectively, the “Platform”) that we, Samruddh Bharat Technologies Private Limited, 4th Floor, KoWo Workspaces, Nizmar Center, 401, Dr Atmaram Borkar Rd, Near EDC House, Altinho, Panaji, Goa 403001 (“Company” / “we” / “our” / “us”), provide for safety and security of citizens and foreigners visiting India through our Platform. Users (“you” / “your”) of the Platform agree to the terms of use as contained herein for using our Platform.

1. By opting to access the Platform and avail our service, you acknowledge and agree that-

   • You have read, understood and agreed to the terms contained in this TOU.
   • Platform includes all future updates, enhancements and new features as may be developed and introduced by the Company from time to time, which will be subject to this TOU.
   • Company reserves the right to edit and update the TOU at its discretion without any notice to you;
   • Platform is for personal and non-commercial use.
   • Platform is meant for safety and security of the citizens of India and other countries living permanently or temporarily and/or visiting and holidaying and/or undertaking trips for business or otherwise in Goa.
   • This Platform is not to be used for any purpose other than safety and security measures in the manner and to the extent provided and comprised in the Platform and as such, any misuse of this Platform is strictly prohibited. In case of violation of this term the concerned User shall be held solely liable for all costs, risks and consequences thereof.
   • Personal Data and Information provided by Users and received by us on the Platform are collected on ‘as is’ basis and the Users remain responsible for the authenticity thereof and in case of any discrepancy therein, the concerned Users are and shall remain liable for all costs, risks and consequences thereof and the Company disclaims any responsibility, liability or obligation of any kind whatsoever in respect thereof.
   • Deliberately providing and/or sharing any forged, fabricated, fake and/or incorrect Personal Data and Information is punishable offence, and any such act will be sternly dealt with, and the concerned User shall be liable for all costs, risks and consequences.
   • Platform, including but not limited to all the features, contents, application software, website, Service, methodology, functionalities, layouts, ideas, inventions and any other work of intellect (whether patentable or not) and all other information and data comprised therein, are copyrighted work of the Company and exclusively belong to the Company.
   • Any copying, adaptation, reverse-engineering, reproduction and any unauthorized use of the Platform or any part or portion thereof is expressly prohibited and any act in breach thereof will be termed as infringement of the Company’s intellectual property which may render you liable for being prosecuted in civil as well as criminal forum for civil and criminal liabilities, and the Company shall be entitled to sue you for appropriate legal remedy including recovery of damage.
   • It is acknowledged and agreed by Users that this Platform being provided by the Company as a safety and security measure at the behest of the government of Goa and in no event shall the Company be liable for any direct, indirect or consequential damage whatsoever arising out of or in connection with use of the Platform.
   • Users are responsible for creating their own account to access and use the Platform by choosing their own username, password etc. and for maintaining confidentiality thereof.
   • Users are responsible for all acts done by them and/or taken place on Users' instructions and/or related to Users, and the Company will not be responsible or liable for any misuse of your account in any manner whatsoever, provided that Users will be liable to compensate the Company for any loss or damage caused to it due to such misuse of account.
   • You are strictly prohibited from using the Platform for any purpose which is unlawful or wrongful or is in violation of the terms of this TOU.
   • You specifically agree not to use the Platform-
     • for any malicious, harassment or any unlawful purpose;
     • for uploading or posting any defamatory, indecent and unlawful materials;
     • for uploading any files containing viruses, malware or any similar software or programme to cause any damage or harm to the Platform or to make any part of it corrupted thereby forcing shutdown of operation of the Platform;
     • for any unlawful and/or unethical purpose;
   • You will not transmit to or upload on the Platform any file or content that (i) is defamatory, obscene, pornographic, threatening, or abusive or harmful, or harassive to any other User or individual, (ii) violates any law, (iii) violates or infringes the rights of any third party, or (iv) is otherwise offensive or objectionable to the Company and other Users of the Platform.
   • We reserve the right to disclose any such Contents, or any other relevant information as may be considered necessary to comply with any Applicable Law and/or to satisfy any government authority.
   • For privacy and protection of Personal Information Users may refer to the Privacy Policy of the Company available on its website;

2. Consent.

   By opting to use the Platform and to share your Personal Data and Information you do hereby give your consent to the Company to process your Personal Data and Information for safety and security purpose as required by the Platform and for any other lawful purpose.

3. Use of Third-Party Sites

   You may use third-party sites for accessing the Platform or switching from the Platform. You understand that the third-party sites are not under the control of the Company and in case of such use of any third-party link and sites, you are advised to verify and conduct appropriate due diligence thereof before using such third party sites and in any event, the Company is not responsible for your use of such third party sites.

4. Updates

   Company reserves the right to update this TOU from time to time as may be deemed necessary by it, without any prior notice to the Users and such updated TOU shall be made effective on and from the date such updated TOU is uploaded on the website of the Company. In case of any conflict of any term of the older version and the updated version of the TOU, the term which is beneficial to the Company shall prevail.

5. Intellectual Property

   All copyright, trademarks, services marks, trade names, logos, patent, design, image, content and all other literary and artistic works comprised in and associated with the Platform are proprietary to and exclusively owned by the Company and nothing comprised therein should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any intellectual property of the Company without prior written permission of the Company. Any unauthorized use of the Platform or any intellectual property comprised therein, attached thereto and/or associated therewith may violate the laws related to intellectual property, information technology and data privacy, resulting in appropriate legal action against you for such violation.

6. Privacy

   For collection, use, sharing and otherwise processing your Personal Data and Information, please refer to, read and follow our Privacy Policy and Data Protection Policy available on the Company’s website.

7. Indemnification

   You agree to and will indemnify and hold the Company harmless and indemnified from and against any claim, demand, loss, or damage, including reasonable attorneys’ fees, for any unlawful use and/or any violation of any term of this TOU or misuse of the Platform, or infringement of any Intellectual Property.

8. Disclaimers of Warranties

   You acknowledge that this Platform is provided by the Company on ‘as is’ basis. To the maximum extent permitted by law, we disclaim all warranties, including any implied warranty of merchantability and fitness. We further disclaim any warranty that this Platform and our Service will meet your requirements or will be constantly available uninterrupted or will be error-free; or that the quality of the Service or the Platform will meet your expectations. We specifically disclaim all liability for any action resulting from your use of the Platform and the Service. We do not: (i) make any warranty with respect to the use of the links provided to our Website or the Platform; (ii) guarantee the accuracy, adequacy or usefulness of any other website, services, or advertisements that may be linked to our Website and the Platform; (iii) make any endorsement of any other websites, services, goods or advertisements that may be linked to our Website and the Platform.

9. No Liability for Interruptions

   The Platform and/or the Website may be unavailable with or without notice to carry out maintenance, troubleshooting or any upgradation work and/or for any action of the government. The Company accepts no liability for any interruption in availability of the Platform and/or the Website or Service.

10. Force Majeure

    In the event of delay or discontinuance of the Platform and/or the Service on account of any force majeure event, the Company will not be liable for any such delay or discontinuance of Service. Such force majeure events include but not limited to, any unforeseen events, which are beyond the reasonable control of the Company, such as fire, flood, natural disasters, act of God, strikes, blockade, war, terrorism, riots, pandemic, epidemic, insurgency, political turmoil etc. Service will resume on elimination of such force majeure event.

11. Termination

    The Company reserves the right to discontinue the Platform and the Service and consequently to terminate your account at any time with immediate effect by giving general notification thereof on the Platform and/or our website.

12. Valid Agreement

    This TOU is a valid agreement between you and the Company and is legally binding upon you and is enforceable in law.

13. Governing Law and Jurisdiction

    This TOU and all matters and actions relating to and/or arising out of use of the Platform and Service shall be governed by the laws of India and the Courts in Goa shall have the sole and exclusive jurisdiction over any such matter.

14. Refund Policy

    We strive to provide the best services and ensure a seamless customer experience. However, please be aware of the following policy regarding returns and refunds:

    Once a service is subscribed, we do not accept any refund requests. We encourage customers to carefully review their orders before finalizing the purchase to avoid any inconvenience.

    All sales are final. We do not offer refunds for any service purchased through our platform. This includes, but is not limited to, digital services or tools subscribed.
